1. Registration in the program
Registration in the Partner Program from BYTES.ua grants the status of a Partner of the company. By registering in the BYTES.ua Partner Program, the Partner accepts the terms of this Agreement and undertakes to comply with them.
During registration in the affiliate program, the Partner undertakes to provide correct data. BYTES.ua has the right to request documents to confirm the correctness of the data.
BYTES.ua has the right at its own discretion to reject an application for registration in the Partner Program, in particular, if the partner site does not meet the goals of the program or contains information that is illegal.
The purpose of Partners' participation in the BYTES.ua Partner Program is to attract customers who will use BYTES.ua services for at least two months. Affiliate earns a commission for referred customers on the terms described in this Agreement if they act in accordance with the objectives of the program.
2. Use of links
A BYTES.ua partner can use those methods of attracting customers that meet the purpose of the Partner Program and do not contradict the forms specified in Clause 6 of this Agreement.
To achieve the goal of the program, the Partner uses graphic and text affiliate links. These links may contain the BYTES.ua name and/or logo.
The partner is granted a limited non-exclusive, non-transferable right to access and download such links and other advertising materials for the promotion of BYTES.ua services. The link can be visually changed with the consent of BYTES.ua.
3. Sales tracking
When a user clicks on an affiliate link, the script used by the Affiliate Program records the date and IP address from which the user accessed the page. IP addresses are tracked in a database linked to the Partner's account. When the user decides to order a service, the script uses this data to determine which Partner will be charged a commission. With the help of this database, as well as cookies, visitors who clicked on the affiliate link will be able to order the service without losing a commission (if the IP address and the cookie are not deleted).
4. Payment of commissions
Commissions in the BYTES.ua Partner Program are calculated according to the commission structure at the link https://bytes.ua/ua/affiliates/. Commissions are paid after verification of orders placed by clients engaged by Partners. The company guarantees the ability to pay commissions on the last day of each month, provided that on the day of payment Partner commissions are valid, their total amount is the hryvnia equivalent of $50 or more, and payment from each client brought by the partner is the hryvnia equivalent of $20 or more.
The partner undertakes to submit an application for withdrawal of the accrued partner commission at the beginning of each calendar month, if the conditions for the minimum payment amount are met. If the partner has not submitted an application within the specified period, BYTES.ua has the right to limit the amount of the monthly payment to the hryvnia equivalent of $1000. If the accrued commission exceeds the hryvnia equivalent of $1000, BYTES.ua will pay the affiliate commission monthly within the limits of this equivalent until it pays all the funds for the accrued affiliate commissions. BYTES.ua does not issue affiliate commissions to ruble bank cards.
Before issuing commissions, BYTES.ua has the right to request documents and data from the Partner to confirm the authenticity of data about the Partner, as well as information about the sources from which the Partner attracts customers to achieve the goals of the Partner Program. If the Partner refuses to provide data, he refuses to participate in the Affiliate Program, and his commission is canceled.
The commission becomes valid after thirty-five days from the moment of payment of the bill. The test order is not considered paid, so the invoice for the continuation of the test service must be paid for the commission to be charged. In this case, the commission will be paid after thirty-five days from the moment of payment of the invoice for the extension of the test service. If within 35 (thirty-five) days the order is canceled for any reason - at the request of the client, due to the client's failure to comply with the rules for using the service or for any other reason - the commission is canceled.
BYTES.ua reserves the right to reject commissions if they are earned on services:
which the involved client paid for more than 25% with bonus funds from the balance on BYTES.ua;
which the involved client received at a discount;
with reduced cost.
Discounted services include the following packages:
Site 1, Site 2, Site 3, located at https://BYTES.ua/ukr/domain-plus-hosting/;
BYTES.ua has the right to supplement this list at its discretion.
BYTES.ua has the right to extend the activation period of the commission at its discretion.
5. Responsibilities of the Partner
Attracting current and potential customers and/or visitors within the framework of this Agreement, the Partner undertakes to comply with the legislation of Ukraine and international legislation, in particular, that which regulates advertising activities and conduct of electronic correspondence.
The partner undertakes to request the withdrawal of funds every month in accordance with the procedure specified in Clause 4 of this Agreement.
BYTES.ua reserves the right to accept or reject any application for participation or partner commission.
The Company undertakes to charge the Partner a commission for the involved buyers who purchase BYTES.ua services using the partner link, in accordance with the procedure for payment of payments specified in Clause 4 of this Agreement.
Any of the parties to the Agreement may terminate it at any time. Partner commissions are charged only if the Partner is a party to the Agreement at the time of charge.
6. Violation of the conditions of the Affiliate Program
Under the terms of the BYTES.ua Partner Program, the following are prohibited:
registration of the same person as a Partner and as a referral of this Partner;
violation of intellectual property rights;
unfair advertising, including false statements and links that mislead customers;
illegal mailing, in particular spam, mass e-mail;
advertising on sites containing content, the posting of which is prohibited by the legislation of Ukraine;
the use of contextual advertising in Google AdWords, Yandex.Direct and other advertising systems, which will drive traffic to the BYTES.ua company website, as well as the use in these systems of key phrases containing the word BYTES.ua and derivatives of this phrase, in particular hostik, host AI Q, host iq, BYTES, BYTES.ua and others;
use of methods that contradict the legislation and the Agreement;
imitation of an order by entering deliberately incorrect, non-existent or foreign data without the knowledge of their owner;
use of any technologies and types of cookie stuffing (cookie dropping).
It is forbidden to use scripts that place cookies on sites that the User has not visited or viewed. It is forbidden to rearrange, replace, and erase the User's cookies on other ones that do not belong to the sites that the User viewed. In particular, replace cookies with the use of pop-ups, iframes, as well as replacement when inserting the address of a third-party page as an image on an existing site;
register and/or use for promotion domains or accounts in social networks, forums and other online resources with names similar to the BYTES.ua domain, maintain pages on these resources on behalf of BYTES.ua;
mislead users, give false information about BYTES.ua;
use automatic redirect, pop-up windows and any other intrusive types of advertising to attract customers: PopUp, PopUnder, ClickUnder, Toolbar, Push-notification, Web-push-notification, etc.;
attract users by promising them a reward for ordering a service: cashback, refund of part of the funds, fixed bonus;
use doorways to attract traffic;
post affiliate links on coupon sites;
fraudulent actions.
If the BYTES.ua company detects any of the listed violations, it has the right to block the Partner's account and cancel the accrued or pending commission. After blocking the account, it is forbidden to create a new one.
7. Term of validity of the Agreement. Changing the terms of the Agreement
The terms of this Agreement come into force from the moment of registration in the Affiliate Program. They become invalid after the cancellation of the Partner's account.
BYTES.ua may change the terms of this Agreement at any time. Changes take effect from the moment of publication of the new version of this Agreement. If the Partner has not expressed his intention to terminate this Agreement after its change, he is considered to have accepted the changed terms.
8. Limitation of liability
BYTES.ua is not responsible for indirect damages, loss of profits or commissions related to failures in tracking sales, loss of database files and any results of program or site actions. In addition, the aggregate liability arising out of this Agreement may not exceed the total amount of commission paid or payable to Affiliate under this Agreement.
9. Disclaimer
BYTES.ua makes no express or implied warranties or representations regarding the affiliate program and services. The client brought to the company by the Partner is served on an equal footing with all other clients of the company, and therefore has the same scope of rights and obligations as the rest of the Customers. BYTES.ua does not give any guarantee that the provision of the Affiliate Program as a service will take place on an ongoing basis. Also, the Company is not responsible for any consequences arising from the use of this program.
The company BYTES.ua cannot be held responsible for the consequences of any error during the operation of the Program, in particular, but not limited to the human factor.
10. Resolution of disputes
In case of disputes, the parties are governed by this Agreement, as well as the legislation of Ukraine.
