Terms of use of services


The following information is the rules for using the services provided by the website https://bytes.ua/. It is part of the official offer for using these services.
The specified rules of use are a public contract of affiliation and, in accordance with the current legislation of Ukraine, have due legal force. The conditions of the rules of use are the same for all consumers and cannot be changed by the other party to the contract.
Registration of the Customer in the accounting system on the Contractor's web server is considered full and unconditional acceptance of the rules of use.

1. Rules for using hosting services

1.1. It is not allowed to exceed the limits of services (resources) provided by the Contractor in accordance with the tariff plan used by the Customer for more than 30 seconds.
1.2. The Contractor is not responsible for unauthorized access to the Customer's web system (in particular, if it caused errors, interruptions in work, deletion of files, change of functions, etc.).
1.3. In order to prevent unauthorized access to the web system, unauthorized mailings, and the spread of viruses or other malicious programs, the Contractor uses third-party anti-spam, viruses, and other malicious programs on its equipment. The specified measures, due to objective reasons, cannot be considered by the Parties as measures that guarantee the termination of the specified phenomena, and cannot be the basis for presenting relevant claims to the Contractor on the part of the Customer.
1.4. The customer is obliged to use the MySQL database in such a way as not to endanger the overall performance of the server. Otherwise, the Contractor may limit the time of access to such a resource.
1.5. The Contractor, providing hosting services, does not initiate the transfer of information, does not choose the recipient of information, does not affect the integrity of the transmitted information, does not control the content of information stored, published or distributed by the Customer using the services provided by the Contractor, and does not bear any responsibility for the accuracy, quality and the content of such information.
1.6. The Contractor is not responsible for the violation of the rights of third parties caused as a result of the actions of the Customer made using the services provided by the Contractor.
1.7. The Contractor has the right to suspend the provision of services under this Agreement in the event that the Customer uses the services provided for:
advertising of services, goods, other materials, the distribution of which is limited or prohibited by current legislation;
using false return e-mail addresses when sending e-mails and other communications;
committing actions or mediation in actions aimed at disrupting the normal functioning of elements of the Internet (computers, other equipment or software) that do not belong to the Customer, in particular, committing DoS/DDoS attacks, using Botnets, public DNS converters with allowed recursion ;
publication and/or distribution of any information contrary to current Ukrainian or international legislation;
use of intellectual property objects without the consent of the right holder, except for cases in which the law allows such use without the consent of the right holder;
publication and/or distribution of any information or software that contains computer viruses or is capable of harming other Internet users;
reproduction or distribution of software protected by copyright or other rights without the permission of its owner or legal right holder;
sending or forwarding "chain" messages of any type;
spam mailings, namely electronic messages delivered to Internet users without their prior consent and/or such that do not allow identifying the sender of these messages, in particular due to specifying in them a false or falsified address of the sender;
making attempts to gain unauthorized access to the Contractor's resources and other systems accessible via the Internet;
publication or implementation of fraud schemes, information about software hacking, implementation of any other similar actions;
placing any programs, the purpose of which is to hide the real IP address of the client, and which may be aimed at committing illegal actions. Namely: open and private/personal proxy programs (3proxy, TOR in any mode of operation, etc.), as well as any programs equated to them, including all those equated to proxying, settings iptables (port forwarding);
hosting anonymous online conferences, including IRC servers;
posting of pharmaceutical sites, as well as offers for the sale of any drugs without providing official documents confirming permission to sell such drugs, as well as using the service to host sites that offer or advertise the sale of chemicals belonging to the group of narcotic, psychotropic drugs or precursors;
distribution of secret and personal information without providing an official document that allows the distribution of such data;
launching public bit-torrents and any P2P applications;
illegal/unauthorized access to computer systems and networks: both belonging to the Contractor and third-party computer systems and networks accessible via the Internet;
using the service as a transit proxy server from the UA-IX environment to the global world environment or vice versa;
using the service with deliberately suboptimal system settings, which negatively affect the performance of the Contractor's equipment and make it difficult to provide the service to other users;
use of anonymizers.
1.8. The Contractor also has the right to suspend the provision of services under this Agreement in case the Contractor receives messages (complaints) about spam sent from any point of the Internet and advertising the Customer's web system (or informing about the Customer's web system).
1.9. The Contractor has the right, without prior notice to the Customer, to temporarily suspend the provision of services in the following cases:
if, based on the Contractor's well-founded opinion, the Customer's use of the services may harm the Contractor and/or cause failure of the Contractor's and/or third parties' technical and software tools;
any actions of the Customer related to the publication, distribution, mailing, transmission in any way of any information or software containing viruses or other harmful components;
any actions of the Customer related to the publication, distribution, mailing, transmission in any way of any information or software containing computer codes, files or programs intended to disrupt, destroy or limit the functionality of any computer computer or telecommunications equipment or programs for unauthorized access;
any actions of the Customer related to the publication, distribution, mailing, transmission in any way of any information or software containing serial numbers for commercial software products and programs for their generation, logins, passwords and other means for obtaining unauthorized access to paid resources on the Internet, as well as posting links to the aforementioned information.
1.10. The Contractor provides the Customer with a free relocation service (transfer of the site/sites) from another hosting (not the Contractor's hosting) to virtual hosting (packages S, V), subject to a minimum payment for the hosting service per quarter. The issue of free relocation subject to payment for 1 month, as well as the number of sites transferred free of charge, is decided individually with the Customer. In case of a technically complex and/or time-consuming transfer, the Contractor has the right to ask the Customer to pay for the virtual hosting service for a longer period or issue an invoice for the transfer service in accordance with the current system of payment for the work of technical specialists, the cost of which must be notified to the Customer. The contractor reserves the right to refuse the transfer for technical reasons, which he undertakes to inform the customer before or during the work on the transfer.
1.11. When using the services, it is prohibited to:
restrict other users' access to the Internet or prevent other users from using the Internet;
use the services to create obstacles in the work of the Contractor's computer systems and/or its clients, scanning and other destructive actions against the Contractor's computer networks and systems and other networks and systems on the Internet, in particular, the organization of DoS, DDoS, SYN-attacks is prohibited flood, UDP-flood and similar actions;
use services for illegal/unauthorized access to the Contractor's computer systems and networks and third-party computer systems and networks accessible via the Internet. Among them, the selection of passwords (which is not yet access) and actions aimed at obtaining unauthorized access to systems belonging to third parties are prohibited. Actions aimed at the organization of networks that are created with an illegal purpose and goals listed in the previous clauses of the Rules for the use of services (organization of a Botnet, use of hosting services as a botnet controller, etc.) are prohibited;
use the service as a transit proxy server from the UA-IX environment to the global world environment or vice versa, and take any actions aimed at anonymous access to external networks using a virtual server as a transit point, such as TOR and other networks, intended for hiding data about network activity, as well as creating IRC servers;
host any programs, the purpose of which is to hide the real IP address of the client, and which may be intended to commit illegal actions. Namely: open and private/personal proxy programs (3proxy, TOR, etc.) and any other programs that equate to them, including any iptables settings that equate to proxying (port forwarding);
host domains in any zones (TLD) registered in the Russian Federation and Belarus: .ru, .su, .рф, .moscow, .москва, .ru.com, .ru.net, .рус, .деты, .online, .site, .bel, .by and all others;
carry out any commercial and non-commercial activities related to the sale, resale and distribution of information (software and other products), the right holder of which is not the Customer, unless the latter is permitted by the owner of such information, software or other products;
use file sharers;
use hosting services as a financial pyramid (hype/HYIP);
use hosting services as an online casino;
use hosting services as a gaming business;
use hosting services to place doorways - sites/web pages specially optimized for 1 (one) or several search queries with the sole purpose of getting them to high positions in the search results for these queries.

2. Rules for using VPS server services

2.1. When using email services, the Customer undertakes to comply with the following conditions:
send no more than 1000 letters from 1 VPS within 1 hour;
each letter sent by the Customer must have no more than 20 recipients.
2.2. If there is a vulnerability in the work of the VPS, the Contractor has the right to reboot the Customer's VPS no more than 2 (two) times in 1 (one) month, without notifying him, to install updates, as well as to eliminate vulnerabilities that may be of a critical nature. This clause applies only to those VPS for which the "Full Administration" service has been paid for and activated.
2.3. In case of consumption of more than 5 TB of traffic while using the VPS service, the Contractor has the right to reduce the bandwidth of the server interface to 10 MBit/s until the end of the calendar month in which the traffic usage was exceeded. From the first of the following month, the speed limit will be restored to its original value.
2.4. Traffic is limited according to the tariff plan. If the traffic limit set by the tariff is exhausted, the Customer has the opportunity to buy additional traffic or switch to a higher plan. Funds paid for additional traffic are non-refundable. If the VPS uses up the monthly traffic limit, the service may be blocked until the start of the next period.
2.5. Disk space is allocated according to the tariff plan. Disk space up to 4 GB may be occupied by the system and unavailable for downloading content. The customer has the opportunity to order additional disk space or upgrade to a higher plan. Fees paid for additional disk space are non-refundable.

3. Rules for using virtual hosting services

3.1. When using the Contractor's services, the Customer must comply with the following requirements:
the number of requests generated to the databases should not exceed 10 % of all requests on the server lasting more than 1 second at any time;
each account must not use more than 10 % of the entire server's processing time for more than five seconds;
no more than 20 PHP processes should be running at the same time;
cron scripts should not run more often than once every 15 minutes. It is forbidden to run more than five cron scripts at the same time;
connection to MySQL and PostgreSQL database services is allowed only with the help of site scripts hosted on the same server. It is forbidden to connect to the database services of virtual hosting accounts from the outside, both from VPS and from third-party servers.
3.2. Using the disk subsystem
The information posted on the Customer's website must consist of HTML pages and other similar pages at 90 % or more. Standard design pages consisting of HTML-based text and graphics are allowed. Downloads, media, streaming content, or files larger than 500KB must not exceed 10 % of total server space used. When using the Contractor's services, the Customer undertakes to adhere to the following restrictions:
audio, video and any media files (such as .avi, .mp3, .mpeg, .jpg, .gif and their analogues) must not occupy more than 5000 MB of server disk space;
archives and images should not occupy more than 5000 MB of server disk space;
databases, in particular sql-files and database dumps, should not occupy more than 5000 MB of server disk space;
executable files and other files resulting from program compilation must not occupy more than 5000 MB of server disk space;
e-mail files must not occupy more than 5000 MB of server disk space;
in case of regular exceeding of the limits (5 or more times), the Contractor has the right to suspend the provision of the service.
3.3. Use of email services
When using email services, the Customer undertakes to comply with the following conditions:
send no more than 200 letters from one domain within 1 hour;
each letter sent by the Customer must have no more than 20 recipients;
the use of mail clients with the configured IMAP protocol is allowed only for mailboxes whose size does not exceed 5 GB;
the use of mail clients with configured POR3 protocol is allowed only for mailboxes whose size does not exceed 1 GB;
if the mail client is used using the POP3 protocol, the permissible number of checks is 100 times per hour;
mail is sent bypassing the local mail service only through a third-party SMTP server. It is forbidden to send mail using any other software to bypass the local postal service.

4. Rules for using VIP hosting services

4.1. When using the Contractor's services, the Customer must comply with the following requirements:
the number of requests generated to the databases should not exceed 10 % of all requests on the server lasting more than 1 second at any time;
each account must use no more than 20 % of the entire server's processing time for more than five seconds;
no more than 40 PHP processes should be executed at the same time;
cron scripts should not run more often than once every 15 minutes. It is forbidden to run more than five cron scripts at the same time;
connection to MySQL and PostgreSQL database services is allowed only with the help of site scripts hosted on the same server. It is forbidden to connect to the database services of virtual hosting accounts from the outside, both from VPS and from third-party servers.
4.2. Using the disk subsystem
The information posted on the Customer's website must consist of HTML pages and other similar pages at 90 % or more. Standard design pages consisting of HTML-based text and graphics are allowed. Downloads, media, streaming content, or files larger than 500KB must not exceed 20 % of total server space used. When using the Contractor's services, the Customer undertakes to adhere to the following restrictions:
audio, video and any media files (such as .avi, .mp3, .mpeg, .jpg, .gif and their analogues) must not occupy more than 20,000 MB of server disk space;
archives and images should not occupy more than 20,000 MB of server disk space;
databases, in particular sql-files and database dumps, should not occupy more than 20,000 MB of server disk space;
executable files and other files resulting from program compilation must not occupy more than 20,000 MB of server disk space;
e-mail files must not occupy more than 20,000 MB of server disk space;
in case of regular exceeding of the limits (5 or more times), the Contractor has the right to suspend the provision of the service.
4.3. Use of email services
When using email services, the Customer undertakes to comply with the following conditions:
send no more than 500 letters from one domain within 1 hour;
each letter sent by the Customer must have no more than 20 recipients;
the use of mail clients with the configured IMAP protocol is allowed only for mailboxes whose size does not exceed 10,000 MB;
the use of mail clients with configured POR3 protocol is allowed only for mailboxes, the size of which does not exceed 10,000 MB;
if the mail client is used using the POP3 protocol, the permissible number of checks is 100 times per hour;
it is allowed to send mail bypassing the local mail service only through a third-party SMTP server. It is forbidden to send mail using any other software means of mail bypassing the local postal service.

5. Rules for using reseller hosting services

5.1. When using the Contractor's services, the Customer is obliged to comply with the requirements of the package he is using. The customer undertakes to ensure compliance with the following restrictions by each client of the reseller:
the number of requests generated to the databases should not exceed 10 % of all requests on the server lasting more than 1 second at any time;
each account must not use more than 10 % of the entire server's processing time for more than five seconds;
no more than 10 PHP processes should be running at the same time;
cron scripts should not run more often than once every 15 minutes. It is forbidden to run more than five cron scripts at the same time;
connection to MySQL and PostgreSQL database services is allowed only with the help of site scripts hosted on the same server. It is forbidden to connect to the database services of virtual hosting accounts from the outside, both from VPS and from third-party servers.
5.2. Using the disk subsystem
These limits apply to each reseller's customer.

When using the Contractor's services, the Customer undertakes to adhere to the following restrictions:
audio, video and any media files (such as .avi, .mp3, .mpeg, .jpg, .gif and their analogues) must not occupy more than 5000 MB of server disk space;
archives and images should not occupy more than 5000 MB of server disk space;
databases, in particular sql-files and database dumps, should not occupy more than 20,000 MB of server disk space;
executable files and other files resulting from program compilation must not occupy more than 5000 MB of server disk space;
e-mail files must not occupy more than 5000 MB of server disk space;
the number of used index descriptors (inodes) must not exceed 200,000 for each account created by the reseller;
in case of regular exceeding of the limits (5 or more times), the Contractor has the right to suspend the provision of the service.
5.3. Use of email services
These limits apply to each reseller's customer.
When using email services, the Customer undertakes to comply with the following conditions:
send no more than 200 letters from one domain within 1 hour;
each letter sent by the Customer must have no more than 20 recipients;
the use of mail clients with the configured IMAP protocol is allowed only for mailboxes whose size does not exceed 5 GB;
the use of mail clients with configured POR3 protocol is allowed only for mailboxes whose size does not exceed 1 GB;
if the mail client is used using the POP3 protocol, the permissible number of checks is 100 times per hour;
it is allowed to send mail bypassing the local mail service only through a third-party SMTP server. It is forbidden to send mail using any other software means of mail bypassing the local postal service.
5.4. The contractor has the right to completely or partially suspend the provision of services to the reseller's clients in the cases provided for in the Public Offer and the Rules for the use of services, without prior additional warning to the reseller's client. The customer receives a notification about the complete or partial suspension of his client's service. The customer is not limited in his right to unlock the customer's account.

6. Rules for using domain registration and domain extension services

6.1. The terms of domain registration services and domain extension are established by this Agreement, as well as by the domain registration rules, which are used when registering domains in the relevant domain name zone.
6.2. An unpaid domain registration service order is not a reservation by the Executor of a domain name for the Customer.
6.3. Using domain registration and extension services, the Customer undertakes to comply with Ukrainian and international legislation.
6.4. The Customer independently monitors the expiration date of the domain name registration, while the Contractor is not responsible for the consequences associated with the expiration of the domain registration period, if the Customer did not timely order the domain extension service or if the Contractor did not provide the domain extension service due to the Customer's violation of the terms of the Agreement .

7. Rules for using SSL certificate registration services

7.1. The customer undertakes not to use the services for the purpose of carrying out activities prohibited by the legislation of Ukraine or international legislation.
7.2. The Customer is responsible for violations of applicable legislation committed by the Customer or a third party through the use of services provided to the Customer by the Contractor.

8. Rules for using the Cloud VPS service

Terms and definitions
Planned technical work is a set of technical operations performed by the Contractor in a specified period of time, necessary to maintain the operability of the servers.
Emergency technical work is a set of technical operations performed by the Contractor on servers outside the scope of scheduled technical work to eliminate the reasons for the unavailability of services provided to the Customer. This work may be caused by the need to install critical updates, patches, replace equipment that has failed, or perform other urgent work necessary to maintain the performance of the servers. In case of emergency technical works, the Contractor undertakes to take all possible measures and inform the Customer about such works as early as possible.
The reporting period is a term equal to one calendar month from the first to the last date.
Basic technical support is a type of support that includes:
consulting on working with the infrastructure control panel;
assistance with transferring data from other servers to VPS in the Contractor's infrastructure;
backup settings to remote servers of the Contractor;
installation and configuration of standard services (nginx, apache, mysql, php, postfix, proftpd, bind);
installation of standard PHP/Nginx/Apache modules;
installation of the OS from the image of the Performer;
installation of a hosting control panel supported by the Contractor (DirectAdmin, WHM/cPanel, Webuzo); the license for the control panel is paid separately by the Customer.
8.1. Service description
The service is an infrastructure service (IaaS) that allows the customer to use the Contractor's IT infrastructure to host its own information systems.
8.2. The procedure for providing basic technical support
The contractor undertakes to provide the customer with basic technical support in the form of tickets. The maximum time for processing a customer's request in the ticket system is no more than 4 hours.
8.3. Warranties and indemnities
The customer gets the opportunity to interact with the technical support service of the Contractor using the ticket system - 24 hours a day and 7 days a week.
8.3.1. Planned technical works
The contractor reserves the right to carry out planned technical works that may cause interruption of the service. The contractor is obliged to notify the customer 72 hours before the start of the planned technical works. The unavailability of the service due to such works cannot exceed 4 hours during the reporting period. If the unavailability of the service as a result of this type of work exceeded 4 hours during the reporting period, the Customer has the right to receive compensation in accordance with clause 8.3.4.
8.3.2. Emergency technical works
The contractor reserves the right to carry out emergency technical works. In the case of emergency technical work, the Contractor reserves the right to notify the customer immediately before the start of the service interruption. The unavailability of the service will be equal to the actual time required to eliminate the problem/prevent a critical situation. Service interruptions caused by urgent work are not subject to compensation and are not taken into account in the calculation of service availability.
8.3.3. Service interruptions are not subject to compensation if they are the result of:
changes in settings by the customer, which directly or indirectly affected the receipt or provision of the service;
delays or defects in the operation of the service related to the software installed by the customer;
hacking of the customer's infrastructure by third parties;
force majeure circumstances.
8.3.4. The contractor undertakes to make every effort to ensure the availability of the service at a level of at least 99.5% during the reporting period. The unavailability of the service may not exceed 4 hours during the reporting period. In the event of a drop in the service availability indicator below the declared 99.5% for the reporting period, the Customer has the right to claim compensation in accordance with the table.

The service availability percentage is calculated according to the formula:
Availability = 100 − (100 ⨯ (Idle time in hours) / Number of hours in the calculation period)
Compensation is provided to the customer in the form of deducting the amount of compensation from the cost of the service for the next billing period in accordance with the table. When calculating the compensation, the average amount of the Customer's expenses for the Contractor's services for the 3 previous billing periods is used. Compensation is calculated according to the formula:
Amount of compensation = (Amount of expenses for 3 settlement periods / 3) ⨯ (Percentage of compensation / 100)
If the Customer uses the services of the Contractor for less than three billing periods, the average amount of the Customer's expenses is considered equal to the amount of expenses for the last billing period.
The compensation cannot exceed 100% of the average cost of the service for the 3 previous billing periods.
During the test period, compensations for the unavailability of the Contractor's services are not accrued.
8.4. Restrictions when using the Cloud VPS OS service
8.4.1. By default, when creating an account in the cloud, the following restrictions are set for each of the available locations (Lviv, Ukraine and Rotterdam, the Netherlands):

8.4.2. The restrictions established in clause 8.4.1 of these Rules may be increased at the Customer's request. The final decision is made by the Contractor and the request may be rejected without giving reasons.
8.4.3. The cloud account also has the following restrictions on the use of unlimited traffic:
a bandwidth limit equal to 300 Mbps for all (incoming and outgoing) traffic is set on the virtual server port;
if within 30 minutes the bandwidth is occupied by 290 Mbit/s or more outgoing traffic from one IP address, the bandwidth of the corresponding virtual server channel may be reduced to 10 Mbit/s until the end of the calendar day Kyiv time;
if within 60 minutes the bandwidth is occupied by 200 Mbit/s or more outgoing traffic from one IP address, the bandwidth of the corresponding virtual server channel may be reduced to 10 Mbit/s until the end of the calendar day Kyiv time.
8.5. Capacity limitation of virtual servers
8.5.1. Depending on the amount of the last replenishment of the units balance (1 unit = $1 or the equivalent in another currency), the client can create servers of different configurations in the cloud:
Available when topping up the balance for any number of units
Number of virtual processors: from 1 to 4.
RAM capacity of one server: from 1024 MB to 8192 MB.
Available when replenishing the balance by 85 units or more
Number of virtual processors: from 4 to 8.
RAM capacity of one server: from 8192 MB to 24576 MB.
Available when replenishing the balance by 209 units or more
Number of virtual processors: from 8 to 24.
RAM capacity of one server: from 24576 MB to 92160 MB.
8.5.2. The customer has the right to short-term use of servers with 4 virtual processors or more and the amount of RAM from 8192 MB without replenishing the balance by 85 units or more. To exercise this right, the Customer must contact the Contractor's support service and explain the need to expand the server configuration for a short time, justifying the reasons for the load jump. The final decision is made by the Contractor and the request may be rejected without giving reasons.
8.6. Suspension and removal of Cloud VPS OS service for non-payment
8.6.1. The units provided to the Customer during the test period can be used for 35 days, after which the remaining units cannot be used, and the provision of the service is stopped. If within 35 days from the moment of activation, the client pays to top up the Cloud VPS OS balance by 10 units or more, the balance of these units is saved and can be used for an unlimited period of time.
8.6.2. During the test period of 35 days, the service will be terminated for non-payment at the time the balance is reset. After the first paid top-up of 10 units or more, the service is stopped on the third day after the balance is reset, with an unchanged average monthly consumption of units. Therefore, a significant increase in the cost of units after the balance is reset may result in the service being suspended earlier than the third day after the reset.
8.6.3. Suspension of the service for non-payment means disconnection of all the client's virtual servers and blocking of access to the cloud control panel. At the same time, all data on the servers, as well as general cloud settings, are saved. At the same time, units continue to be billed for resources, the use of which is not actually affected by the suspension of the service: disk, IP address, network, disk image, virtual machine image. Thus, the balance of suspended account units becomes negative.
8.6.4. Simultaneously with the suspension of the Cloud VPS OS service, the service "CDP-backup 10 GB (free)" is stopped.
8.6.5. To resume service provision, it is necessary to replenish the balance of units by such an amount that after replenishment the balance of units becomes positive. If the balance for the paid package is not replenished within 27 days from the moment of suspension of services, the Customer's account in Cloud VPS OS is permanently deleted, including the Customer's general settings and data. If the balance for the test package is not replenished within 3 days from the moment of suspension of services, the Customer's Cloud VPS OS account is permanently deleted, including the Customer's general settings and data.
8.6.6. CDP Backup 10 GB (Free) service is deleted 30 days after the Cloud VPS OS service ordered with it, along with all data backups, if any.
